Implementing the anti-fraud plan in line with the general policy of the whole Customs sector, Dong Nai Customs Department has implemented many synchronous and specific solutions to each unit. Accordingly, many violations have been detected and handled in a timely manner
Block electronic goods, textiles fake origin
Recently, EV JSC. with the address in Hung Yen province opening a declaration at the Dong Nai Customs Department importing 706 million dong worth of goods being all kinds of curtains. On the declaration, the company declares C / O form E, origin of goods in China. The physical inspection results show that the shipment of 4,331 curtains has been sewn completely and packaged directly in plastic packages. Especially, on these packages, their origin is in Vietnam. As such, all of these curtains were printed with fake information of Vietnam origin before being imported into Vietnam.
On the basis of actual inspection, the Dong Nai Customs Department reported to the General Department of Customs for guidance on handling. Accordingly, the General Department of Customs stated that enterprises have committed unfair competition acts due to the use of commercial indications that cause confusion as to the origin and conditions for supplying goods and services according to the provisions at Point b, Article 130 Intellectual Property Law. Therefore, the General Department of Customs requests Dong Nai Customs Department in accordance with Clause 4, Article 15 of Decree 99/2013 / ND-CP to consider and handle violations of enterprises. The sanction level is prescribed in Article 14 of Decree 99 on unfair competition acts in the field of industrial property, with a maximum fine of VND 250 million.
Similarly, through checking at the warehouse of A. VN Electric Machinery Co., Ltd, Dong Nai Customs Department and the interdisciplinary inspection team under the Steering Committee of 389 Dong Nai Province discovered 356 washing machine products imported from China with signs of changing product labels on imported products, changing indications of origin, place of production of goods are in Vietnam. The company also acknowledged the act of labeling Vietnamese products on imported products. Therefore, the inspection team issued a decision to seal off violated goods and transfer the case file to the Investigation Police Agency (PC03) – Dong Nai Province Police continued to investigate, verify and clarify.
Strengthen checking and checking
Dong Nai Customs Department said that from now until the end of the year, the Department still determined that combating frauds of origin, illegal transmission and counterfeiting of goods labels is an important task. Recently, the unit has decided to set up a provincial steering committee to implement the plan of checking, verifying origin, combating fraud, counterfeiting origin, labeling of goods, infringing intellectual property rights, transferring illegal download. In which, a Deputy Director is the Head of the Committee with 17 members who are leading the departments. This Board is tasked to continue to direct the implementation of plans to strengthen inspection, identify the origin, combat fraud, counterfeiting origin, labeling, infringement of intellectual property rights, illegal transmission; at the same time, direct the handling of problems arising in the process of implementing the plan.
According to the Steering Committee representative, there are two cases that businesses often take advantage to cheat the origin. Firstly, enterprises import semi-finished products, then simply process and get Vietnamese origin. Secondly, enterprises import finished products without labels or with foreign labels then replace the labels of counterfeit origin of Vietnam for export or domestic consumption. Therefore, in the coming time, Dong Nai Customs Department will continue to review import declarations from some key markets, including focusing on wooden, garment and electronic products … strictly control to promptly detect frauds of enterprises.
According to Mr. Nguyen Phuc Tho, Deputy Director of Dong Nai Customs Department, the unit will closely coordinate with the functional forces in the area such as the Police, Market Management, inland tax authorities … to identify the key commodities and enterprises show signs of risks, fraud, counterfeiting of origin, labeling of goods, illegal transshipment like new import-export enterprises and foreign-invested enterprises.
The unit continues to review abnormal transactions, the import-export turnover has increased sharply, not suitable with the capacity and production scale from countries that are subject to trade remedies and enterprises with needles. Export turnover of goods has increased sharply to major markets. On that basis, conduct analysis, verification and clarification of information on businesses, high-risk items in origin fraud, labels … actively develop coordination plans, apply inspection measures , verify clarification of signs of origin infringement.
